Gurung Kirpa v. Sparkle Environmental Services Limited
The plaintiff brought a personal injury action arising out of a workplace accident while employed as a street cleaning worker. The defendant was alleged to have breached its duty of care by failing to assess risks of falling objects and failing to provide proper safety equipment, contrary to its obligations as employer. The plaintiff was represented by counsel as instructed by Mr. Chaudhry Muhammad Kamran of Chaudhry Solicitors. The Court found the defendant negligent, held it 100% liable, and awarded damages, marking a landmark judgment.
